Yeah he's done. He almost wasn't in Spiderman 2 either cause of back problems but Sony pictures said they would drop the movie all together if he wasn't in it.
He only had a contract for 3 movies and now he's bye bye. They tried to cram way too much story into SM3 and it didn't really work. The fight scenes were cool.

That movie sucked shit bad. I fucken hated it. Why does every super hero movie sequal have to have more than one bad guy? Venom was gay as fuck and the story was gay as fuck too. Tobey said he wouldn't count out doing another spiderman movie just yet but that would suck cause he is a shitty spiderman

Man, I loved that fuckin' movie. Saw it last weekend and it was like "okay, summer is on." Everything I'd ever want in a big budget Summer type movie was there. Walked out feeling like I spent my $5.50 wisely (I go to the cheapy theatre early in the day 'cause I'm a cheapskate). I dig the total haphazard reconstruction of the Spiderman mythology too. I know nerds are supposed to get irrate over that shit, but I don't give a FUUUUUUH so long as it's entertaining and keeps a version of the myth alive.
I guess I can see the "too much story" thing, but the other side of that is you're getting more bang for your buck, y'know? But like I said, that's what Summer movies are for: EPIC tales. Like LOTR or Pirates of the Carribean or something.

Venom was always drawn different in different Spiderman series. I never understood how like sometimes Venom looked as big as Juggernaut but then sometimes was slightly bigger than Spidey. I liked the way they made Venom look.
Tobey Macguire is a perfect Peter Parker. The all American white ass nerd. I don't think they could have picked a better Peter. I shouldn't say it too much story really. It was more like too much incomplete or just outta nowhere story.
